Child custody and your children: Make sure they're comfortable

As you work through your divorce, it won't be long before you turn your attention to child custody, visitation and related matters. This is often one of the biggest sticking points in the divorce process, so you need to prepare accordingly.

Once you work through everything with your ex-spouse, either in mediation or litigation, you'll have a parenting agreement and visitation schedule that can guide you in the future.

As you prepare for everything that's to come, keep in mind that there's nothing more important than the well-being of your children. Here are some steps you can take to ensure that they're as comfortable as possible with what's happening:

  • Explain the new arrangement: For example, if you have physical custody of your children, explain to them that they'll be living with you the majority of the time. Also, touch on the fact that they'll be visiting with their other parent based on a predetermined schedule.
  • Answer their questions: Depending on their age, your children will have a variety of questions about child custody and visitation. Do I have to spend time with mom or dad? Will we ever live together in the same house again? It's not easy to answer these questions but do your best.
  • Get on the same page as your ex: It's hard to do with bad feelings circulating, but it's a must if you want to do right by your children. Successful co-parenting takes effort from both parents.

If you've tried everything to make your parenting plan work and your ex continually fights back, learn more about the benefits and process of requesting a modification.
